The above link is to his items for sale. IDK if he is a member here or not..

I bought the gauge pod from him, his ad says "new"

So then he sends me a message and tells me it is missing the hardware, and he had velcro'd it for mock-up.
I asked him for a refund to cover me purchasing the hardware seperatly, he refused.....

we went back and forth in a couple emails, me telling him he misrepresented the goods when he said they were "new"...himi telling me I am off my rocker and to not bother him anymore.

So now i have a paypal claim with him.

I am not paying you $30 for the bezel (shipped), then another $15 to summit or Jegs for the hardware (shipped). I can buy it from Summit for less than that.

This is a as-is auction.

I guess I should have never mentioned anything becasue This is exactly How I got it.

Sure Shipping can vary. I figured I would be polite, And ask if the box was needed. I use the box as a verifier on part.

As you can see it clearly states part number. Also What you see is what you get. Im not refunding you money ($7)?
When I callled around to get a general idea on how much they cost.
Autometer fastners.

The cost can vary- 3-4-5-6-7-8-9-10-11.

Your auction clearly states $5 for shipping, and you display the item with the box, so I would want the box.

Also, you never stated this was missing hardware, so i will want a $7 refund so I can buy the hardware.

I have original box as pictured, looks like there first box as this thing is ancient. I have purchased this unit in porter rico?

Thats where it came from. I used it for a mock up. Put back in box and thats it. I have no fastners with them. JEGS/summit sells them they are 4-7$ a pack.

Do you want orginal box? I can probably ship cheAPER WITH OUT the box is big

Missing hardware is NOT your problem, it's HIS. He is selling it "as new" meaning it should have all the hardware the manufacturer intended included, not your problem if HE got it missing hardware, he should have stated that in the description!

He tells you "What you see is what you get" and then says if you want the packaging you have to pay more for shipping???

Yeah, I'd go after him with PayPal.

damn that sucks, but you can leave him negative feedback as well as getting your money back since paypal will definitely award in your favor.

My only thing with leaving him negative feedback is that he will then leave me negative feedback to retalliate.

He just issued me a refund, after getting nasty with me again:

Dear gunther19820,

Its not even USED. ITS BRAND NEW. the fact that I pulled it out of the original box, touched the actual part. Inspected it. Tested it for fitment is perfectly on me and is validating that it is not even USED.

When autometer makes these what do you think they do? handle it, Package it...

The fastners that are missing? were not even in box. I contacted original seller from puterico and told me it didnt have them.

For item to be used it would have to be either modified. drilled out or broken.

when i say i Tested it for fitment does that mean it was Rounded out, Hogged out, Drilled scraped scratched bent broken to you? does velcro (removeable tape) make it used.

His two descriptions contradict each other. He states new and "unopened", but then has a pic of it opened and states in another section, it was used for mock up.

Under Ebay's current rules I don't think a seller can leave negative feedback for a buyer

You can leave negative feedback, but you have to either report a problem or have an open case with the buyer that isn't resolved. But otherwise, the buyer is safe from negative feedback unless the seller clicks positive and writes a negative comment.

I dont care about the push-pins, the point is I bought an item that was listed as new, and low and behold it was missing parts.
So my thing is why should I pay him the $30 for his misrepresented item, then pay another $6 or $7 for the push-pins? I asked him for the discount for the screws and he said no. Fair enough. So I cancelled the order.
I get that it isnt a lot of money for a couple of those stupid push-pins, but there is also no reason for me to spend more money on it than what I can buy it from Summit or Jegs for.

I only did the paypal claim so i had some way to track the $30. He did refund me the money, and I closed the claim immediatly

He can't leave you negative feedback. The only feedback sellers can leave now is positive. They can't leave negative or neutral feedback anymore.

This is true. A seller completely lost their ability to leave negative/neutral feedback for buyers. I think it is crappy for the sellers in some cases, but Ebay doesn't want sellers turning away buyers with negative feedback, so this is how thei accomplished that (this is what I was told when chatting with a Ebay rep).

I completely agree with the OP. Doesn't matter what the dollar amount is, they guy mis-represented his item, and tried to screw him over. Plain and simple.

Buy it from someone else, and let him take his licks from the next buyer he tries to screw over.

Besides, it came from "Porter Rico", so who knows how the quality would have been!!
