ive had an NJP (ninja punch in the marines). its nothing to get an NJP they cannot discharge you with an NJP. what level NJP are you getting? whos giving it? If I were you I would request Courtmarshall if they have proof they will push it... if not they they wont.. more times than not they will just drop it an repromand you if you request courtmashall becuase they dont want to do all that work. as far as kicking you out.. they cant. bottom line. they have no grounds for discharge.

Ahhh, this reminds me of my own military glory days...Let's see, I was written up once for my wife not wearing a bra while we were cutting thru the Navy Base in Norfolk on the way to the beach. Shit, it was 1975 and chicks didn't wear bras, she was only 17 and didn't really have much in the way of boobies back then anyway. My command, USS Los Angeles SSN-688, thought it was bullshit and tossed it out...Then there was the weed they found in our cubicle in Class A school in Meridian, MS. I was written up along with the other 2 guys in my room, but once I graduated I got all my sigs and checked out, no "legal hold" so I split. Again, my command said it was bullshit and tossed it...Then came my biggie. I'd had enough of submarine life and decided to take 30 days off, which technically is desertion and warrants an automatic transfer. When I turned myself in, the dude counted the days on the calendar and said it was only 29 days, so I told him I was going home and I'd see him tomorrow. He decided to call it 30 days and I was off to Legal Hold to await my punishment and new orders. I waited around for 7 months and saw all the bullshit punishments everyone was getting and Article 15 averaged like 2 pay grades, $600 fine (that's 600 1975 dollars!) and 30 days extra duty. All the guys that went to Courts Martial were getting off MUCH easier, so I requested a Court Martial. I went in there and the dude asked me why I didn't go to work for 30 days and I told him that my alarm didn't got off, he said "You're a real smart as aren't you?" To which I replied "Yes sir, I am!". He sentenced my to 15 days at hard labor, no fine, no loss of pay grade, it was great! I was hauled off in handcuffs and taken to a prison in Portsmouth. Razor wire, machine guns, all the cool stuff. So here I am, just wanting to get out of submarines and I'm in a cell with one guy that raped 2 woman, killed one of them, but the other one survived and he got caught. He used to say "If I'd a just kicked her a few more times..." Another guy robbed an armored truck of 4 Mil and couldn't wait to get out and dig the cash up. Anyway, I got out in 13 days (got 2 off for good behavior)...Then I got my new orders, opened the envelope up and was shocked to find out that I had to go back to that goddam submarine! This time there was a big f'n deal about a drug thing which included a Congressional investigation. It was even on the national news, Walter Cronkite told my mom I was a stoner, woo hoo!They ended up busting 32 of us altogether, but because I had split and had other "issues", they had to wait until I got all that shit straightened out. Anyway, I went to another Article 15 and told the dude that I had already told the XO of my sub that I smoked weed, hoping that I could get transfered to a skimmer, but he didn't do anything, so he said if I would go to rehab, he'd drop the charges, so I did. When I went, some chick asked me if I had a drug problem, I said no, I just wanted to get out of subs, so she sent me home...I eventually got new orders to a skimmer, did the balance of my time (I did get busted with weed in Gitmo, but got out of that one too) and got out with an Honorable Discharge...Yeah, it wasn't just a job, it was an adventure!

Retired Army Major here, just trying to clear up a couple of things.

An "Article 15" is called "Non-Judicial Punishment" because it's designed for a unit (usually a company level outfit) to take care of slapping the wrist of folks who have messed up. There are limits on how much they can fine you or how much rank they can take.

No lawyers, no big hassels, get it over with and get trooper back to duty. Comes in two flavors -- company and "Field Grade". Field Grade Article 15's are much more serious and are presided over by a Field Grade officer (Major/Lt. Commander or higher), usually from the next higher command.

They can seriously mess up your rank and pay, but it's still not a lawyer type thing and shouldn't follow you out of the military.

Next comes the "Courts - Martial" with are lawyer type things and can put you in prison, bust you to E-1 and kick you out with a Bad Conduct Discharge.

Such things follow you out of military and can mess with your life.

One comment on the "1975" thing. Post Viet Nam there were many people in the military that didn't want to be there but that the military couldn't kick out. (Research "MacNamara's 100,000" -- an experiment to use military as "social training ground" Took 20 years to get over that )

Result was some very tight restrictions, etc. and MPs that had little tolerence for anything they didn't like. (I was on active duty then -- it was not fun )


Sounds like your unit understands what happened and is willing to let it ride without busting you anymore. Your CO doesn't want to take on a base commander but is taking care of you -- don't kick dirt on his shoes, it will only make life difficult for both of you, and you're downhill from him. (and we know what rolls downhill )

AP was doing what he thought he had to -- the lying and frat charges were warnings to other trainees that they were being watched.

Believe it or not, prostitution is a problem, especially on training bases, and base commanders tend to do things to make sure it doesn't happen on THEIR base

And are you sure you're being "harrassed" or "teased" about it? If it is making you uncomfortable go up your local chain of command (or to the chaplin -- that kind of stuff is in their job description) and make your concerns known. That's the best way to end it.

Remember, if your unit is unhappy with you there is always Temporary Duty elsewhere -- places not nearly so pleasant!

One thing different to what the ole' Major said. I don't know how other branches work it, but I've seen plenty of cats get kicked out of the Navy after NJP with never having gone to Courts Martial. The CO masts the kid and based on either the offense or the amount of paper work they have on the mark, the CO will give him max punishments available to him, then makes a recommendation to his boss for Seperation. At which point, the offender gets started with his paperwork for getting kicked out, usually with an OTH discharge. I've seen that a few times.

We agree on discharge not being a NJP option, but admin discharges, etc can have NJP as a basis for a speedy exit "for the good of the service"
